Preamble

The website is the sole property of the company MSL WEB, along with all related rights. Any reproduction, in whole or in part, is systematically subject to authorization by the owners. However, hypertext links to the website are permitted without specific requests.

1. Acceptance of Terms

The customer acknowledges having read, at the time of placing the order, the particular conditions of sale set out on this screen and expressly declares to accept them without reservation.
These general terms and conditions of sale govern the contractual relationship between the company MSL WEB and its customer, both parties accepting them without reservation. These general terms and conditions of sale shall prevail over any other conditions appearing in any other document, except with prior, express and written agreement.

2. Products

The photographs illustrating the products aim to describe them as accurately as possible. However, minor modifications may be made, particularly regarding the product's label or logo, which are sometimes subject to change. The vast majority of products offered to customers by the company MSL WEB are available in our warehouse.

3. Order

Automatic recording systems are considered as proof of the nature, content and date of the order. The MSL WEB team confirms acceptance of the customer's order to the email address provided by the customer. The sale will only be concluded upon confirmation of the order. MSL WEB reserves the right to cancel any order from a customer with whom a dispute exists relating to the payment of a previous order. The information provided by the buyer at the time of placing the order is binding: in the event of an error in the recipient's contact details, the seller cannot be held liable for any inability to deliver the product.

Discount codes cannot be combined. 

In the case of the Detailing Academy, it will take place if a minimum of 3 participants is reached. If the minimum of 3 participants is not reached, Maniac-Auto will offer its customer either a refund or the option to reschedule the session. 

4. Delivery

After order confirmation, the company undertakes to hand over to its carrier on the same day all items ordered by the buyer before 1:00 PM on a working day. All orders placed after 1:00 PM will be shipped the following day (except on weekends). The carrier is contractually bound to MSL WEB to deliver the order to the buyer's address provided by the company.

Furthermore, for deliveries outside metropolitan France, the customer undertakes to pay all taxes due on the importation of products, customs duties, value added tax, and any other taxes due under the laws of the country receiving the order. All orders placed on the MSL WEB company's online store are intended for the personal use of customers; customers or recipients of the products are prohibited from any partial or total resale of the products.

Delivery in metropolitan France will be carried out by La Poste using the Colissimo service (without signature, within 48 working hours after handing the parcel to the carrier), Chronopost (with signature, within 24 working hours after handing the parcel to the carrier), or Mondial Relay (to a relay point, 5 working days after handing the parcel to the carrier) for all customers residing in metropolitan France. 

Deliveries to French overseas territories and EEC countries are carried out by La Poste via Colissimo Suivi Europet; for orders placed outside the EEC, deliveries are handled by international postal services.

Always check your parcel upon arrival to note any reservations in case of missing items or damage.
For availability reasons, an order may be delivered to the customer in several installments. The customer will only be charged for one delivery. If the customer wishes to have 2 delivery addresses, they must place 2 separate orders, with the associated shipping costs.

In the event of a failure by MSL Web to fulfill its obligation to deliver the goods on the date or upon the expiry of the deadline provided, or, failing that, no later than thirty days after the conclusion of the contract, the customer may cancel the contract by registered letter with acknowledgment of receipt or by written notice on another durable medium, if, after having formally requested, using the same methods, that MSL Web carry out the delivery or provide the service within a reasonable additional period, the latter has not complied within that period.
The contract is considered canceled upon MSL Web's receipt of the letter or written notice informing it of said cancellation, unless MSL Web has complied in the meantime.
The customer may immediately cancel the contract when MSL Web refuses to deliver the goods or provide the service, or when it fails to fulfill its obligation to deliver the goods or provide the service on the date or upon the expiry of the agreed deadline, and that date or deadline constitutes an essential condition of the contract for the customer. This essential condition arises from the circumstances surrounding the conclusion of the contract or from an express request by the customer prior to the conclusion of the contract. When the contract is canceled under the conditions set out in article L. 216-2, the professional refunds the consumer the total amount paid, no later than fourteen days following the date on which the contract was terminated. 

When the professional has not refunded the total amount paid by the consumer under the conditions set out in article L. 216-3, this amount shall automatically be increased by 10% if the refund occurs no later than thirty days beyond this deadline, by 20% up to sixty days, and by 50% thereafter. 

The default shipping option is delivery to a relay point provided by the carrier Mondial Relay in metropolitan France.

Shipping costs depend on the weight of the parcel to be shipped (as well as its volume for overseas shipments).

Free shipping on orders over €150. There are no shipping costs for customers who wish to collect their order at Maniac-Auto, in Bois d'Arcy.

5. Withdrawal

You have 14 days (from receipt of the items) to make up your mind. You have 14 days to let us know that you wish to withdraw, and then a further 14 days to return the parcel after having notified us of your withdrawal request. In the event of an exchange or refund, please return the item(s) new and intact, accompanied by all possible accessories, instructions for use and documentation to the following address:

In the event of exercise of the right of withdrawal, the company MSL WEB is required to refund the amounts paid by the customer, at no cost, using the same means of payment as that used by the consumer for the initial transaction. The consumer bears the cost of returning the goods. The refund is due within a maximum period of 14 days after receipt of the goods by MSL Web, or after obtaining proof of shipment of said goods.

6. Prices

The price is expressed in euros.
The price shown on the product pages does not include shipping.
The price indicated in the order confirmation is the final price, expressed inclusive of all taxes and including VAT for France and EEC countries. This price includes the cost of the products, handling, packaging and storage of the products, transport and installation costs.

7. Payment

The price charged to the customer is the price indicated on the order confirmation sent by the company MSL WEB.
The price of the products is payable in full on the day of the actual order.
Payment may be made by bank card bearing the CB symbol (see below), by PayPal, by bank transfer, or by check. 

Online, SYSTEMPAY allows you to pay via a banking server of the Banque Populaire in a secure environment.
Your bank card number is therefore directed to the bank's servers; your payment is made directly to a bank in a secure environment without passing through the store's server, a guarantee that is all the more important as your numbers are known only to our banking partner (Banque Populaire). The order validated by the customer will only be considered effective once the relevant bank payment centers have given their approval. In the event of refusal by said centers, the order will be automatically canceled and the customer notified by email. Furthermore, the company MSL WEB reserves the right to refuse any order from a customer with whom a dispute exists.

The company Maniac-Auto will never store its customers' bank card details in its database.


8. Disputes

This contract is governed by French law. MSL WEB cannot be held liable for damages of any kind, whether material, immaterial or bodily, that may result from the improper use of the products sold. The same applies to any modifications to products made by manufacturers. The liability of the company MSL WEB shall, in any event, be limited to the amount of the order and may not be invoked for simple errors or omissions that may have persisted despite all precautions taken in the presentation of the products. In the event of difficulties in the performance of this contract, the buyer may, prior to any legal action, seek an amicable solution, in particular with the assistance of:
a professional association in the sector, a consumer association, or any other advisor of their choice. It is noted that the pursuit of an amicable solution does not interrupt the statutory warranty period or the duration of the contractual warranty. It is noted that, as a general rule and subject to the assessment of the Courts, compliance with the provisions of this contract relating to the contractual warranty assumes that the buyer honors their financial commitments to the seller.
Claims or disputes will always be received with attentive goodwill, good faith being always presumed on the part of anyone who takes the trouble to explain their situation.

In the event of a dispute, the customer shall first contact the company to seek an amicable solution.

If no solution is found, the customer may turn to the consumer mediator Medycis under the conditions set out in Title I of Book VI of the Consumer Code.

Failing that, the customer shall turn to the competent courts. The customer may bring the matter before either one of the territorially competent courts pursuant to the Code of Civil Procedure, or the court of the place where they resided at the time the contract was concluded or the damaging event occurred.

9. Warranty

MSL Web offers a 24-month conformity warranty in accordance with article L217-12 of the Consumer Code.

The liability of the company MSL WEB is systematically limited to the value of the product in question, as assessed at its date of sale.

When acting under the statutory warranty of conformity, the consumer:

-has a period of two years from the delivery of the goods to take action;
-may choose between repair or replacement of the goods, subject to the cost conditions provided for in article L. 217-9 of the Consumer Code;
-is not required to prove the existence of the lack of conformity of the goods during the six months following the delivery of the goods. This period is extended to twenty-four months from March 18, 2016.

The statutory warranty of conformity applies independently of any commercial warranty that may have been granted.

The consumer may decide to invoke the warranty against hidden defects of the item sold within the meaning of article 1641 of the Civil Code, and in that case, may choose between cancellation of the sale or a reduction of the sale price in accordance with article 1644 of the Civil Code.

In any case, the customer benefits from the statutory warranty against eviction and hidden defects (Art. 1625 et seq. of the Civil Code). Provided that the buyer proves the existence of the hidden defect, the seller is legally required to remedy all consequences thereof (art. 1641 et seq. of the Civil Code). 10. Loyalty Program

When you make purchases on Maniac-Auto.com, you can take advantage of loyalty points, entitling you to discounts on your future orders.

Loyalty points are awarded on all orders, excluding Kits and gift cards, and are valid for one year after the sale that generated them.

The customer is awarded 1 loyalty point for every €10 spent (excluding Kits and gift cards). Each loyalty point entitles the holder to a €0.20 discount on their next order within the next 12 months. For example, if you place an order of €125 (without purchasing a Kit or gift card), you earn 12 loyalty points, giving you a €2.40 discount on your next order within the next 12 months.

To use your loyalty points, you can convert them into a gift voucher in the "My Account" section.

11. Legal Information

The provision of personal identification information collected for the purposes of distance selling is mandatory, as this information is essential for processing and dispatching orders, issuing invoices and warranty contracts. Failure to provide this information will result in the order not being validated. In accordance with the "Informatique et Libertés" law, the processing of personal identification information relating to customers has been declared to the Commission Nationale de l'Informatique et des Libertés (CNIL). The customer has the right (article 34 of the law of January 6, 1978) to access, modify, correct and delete the data concerning them, which they may exercise with MSL WEB. Furthermore, the company undertakes not to share, free of charge or for consideration, its customers' contact details with any third party.

Furthermore, the customer has the right to register on the telephone canvassing opt-out list at www.bloctel.gouv.fr. MSL Web undertakes not to canvass its customers and not to resell their personal information.

Rules of the "Kit Detailing Maniac Auto" Contest of December 24, 2024

Article 1: Organization

The company Maniac Auto (hereinafter referred to as "the Organizer"), whose registered office is located at 3 rue Charlie Chaplin 78390 Bois d'Arcy, is organizing a free contest with no purchase obligation on Instagram entitled "Kit Detailing Maniac Auto".

Article 2: Conditions of Participation

The contest is open to any adult natural person residing in metropolitan France, excluding employees of the Organizer and their close relatives.

  • Only one entry per person is allowed (same Instagram account).

  • Accounts created solely for contests or exhibiting suspicious activity may be excluded at the Organizer's discretion.

Article 3: Terms of Participation

To participate in the contest, users must:

  1. Follow the official Instagram account @maniac_auto.

  2. Like the post dedicated to the contest.

  3. Tag two friends in the comments of the post.

Bonus option: Share the post in your story (with the tag @maniac_auto) to double your chances in the draw.

Article 4: Prize

The winner will win a Detailing Kit worth €130 VAT included, comprising a selection of car care products.

  • The prize cannot be exchanged, refunded, or transferred to a third party.

Article 5: Selection of the Winner

The winner will be selected by a draw from among the valid entries meeting the terms indicated above.

  • The draw will take place on January 2, 2025 by the Organizer.

  • The winner will be contacted via private message on Instagram and must respond within 7 days to confirm their details. In the absence of a response within this period, another winner will be drawn by lot.

Article 6: Liability

The Organizer shall not be held liable:

  • In the event of interruption, delay or cancellation of the contest for reasons beyond its control.

  • In the event of loss, theft or damage to the prize during its delivery.

Article 7: Personal Data

The information collected is intended exclusively for the management of the contest and will neither be sold nor transferred to third parties.
In accordance with the GDPR, each participant has the right to access, correct and delete their personal data by writing to [email/contact of the Organizer].

Article 8: Instagram Disclaimer

This contest is neither sponsored nor managed by Instagram. Each participant acknowledges releasing Instagram from any liability regarding the organization or results of this contest.

Article 9: Acceptance of the Rules

Participation in this contest implies full and unconditional acceptance of these rules, available upon simple request from the Organizer.
